Man who raped a teenager who helped his daughter study was sentenced

A Criminal Court of Guayas sentenced José Luis B.A. to 22 years in prison for the rape of a teenager who helped his daughter with homework.

The judges of the Criminal Court, made up of Keltia López, Isabel León and Lenin Quiñónez, accepted the evidence presented by the Prosecutor's Office and issued the conviction, in the degree of perpetrator.

The ruling also includes the payment of a fine of 800 unified basic salaries (USD 340,000) and USD 5,000 as comprehensive reparation to the victim.

The rape occurred on January 12, 2021. According to the Prosecutor's investigation, the 17-year-old victim woke up at night inside the aggressor's home, with pain and bleeding in areas of the pelvis and back.

That day, the minor was waiting for the defendant's daughter to help her with homework and school work, as she had done for some time and for which she was hired.

The teenager left the house and went to her home, where she narrated what happened to her parents. Her parents took her to a nursing home, where the doctors confirmed her rape. They immediately went to the offices of the Flagrancia Prosecutor's Office to report what happened.

Because it was a flagrant act, the police officers went to the home of the now sentenced man, who was still at his residence. There the suspect was arrested and taken to the Police Unit.

Evidence

At the trial hearing, held on the morning of Monday, January 24, 2022, at the Albán Borja Judicial Unit, prosecutor Blanca Noblecilla Guerrero presented as evidence: the testimonies of the investigating agents of the Judicial Police, expert doctors and psychologists who intervened in the case.

Also, from the mother of the adolescent and the anticipated testimony of the victim, in which she fully identified her aggressor.

The Prosecutor's Office said that the expert test of forensic genetics (DNA) was decisive. Also, the comparison of sperm and seminal fluid samples found in the adolescent's underwear on the day of the events, which coincided with those of the aggressor.

To this evidence were added the medical-legal, investigative and psychological reports, the expert analysis of the sample collection from those affected, the recognition report of the scene of the events and the complaint filed by the mother of the affected .
